MY CITY PRIME STORE – E-Commerce Shopping Portal

 

These Terms and Conditions (“Terms”) govern the access, registration, listing, sale, and purchase of products and services on My City Prime Store (“Platform”, “Portal”, “We”, “Us”, “Our”). By registering, listing products, or purchasing through the Platform, you agree to be bound by these Terms.


1. PLATFORM OVERVIEW

My City Prime Store is a multi-vendor e-commerce shopping portal offering products across multiple categories including but not limited to Home Decor, Fashion, Footwear, Electronics, Gifts, Lifestyle, Grocery, Beauty, Kitchenware, Furniture, Toys, and Accessories.

The Platform acts as a technology facilitator and does not manufacture, store, or directly own the products listed unless explicitly mentioned.


2. ELIGIBILITY

  • Sellers must be legally eligible to conduct business under applicable Indian laws.

  • Buyers must be at least 18 years old or use the Platform under parental/guardian supervision.

  • Accurate and complete information must be provided during registration.


3. SELLER REGISTRATION & RESPONSIBILITIES

Sellers agree to:

  • Provide valid GST, PAN, bank, and identity documents where applicable.

  • Ensure all listed products comply with Indian laws, consumer protection rules, and platform policies.

  • Maintain accurate product titles, descriptions, images, pricing, and stock availability.

  • Fulfill orders within committed timelines.

My City Prime Store reserves the right to approve, suspend, or terminate seller accounts without prior notice in case of violations.


4. PRODUCT LISTING GUIDELINES

  • Products must be genuine, original, and legally sourced.

  • Prohibited, restricted, counterfeit, or infringing items are strictly not allowed.

  • Images must be clear, accurate, and must represent the actual product.

  • Misleading claims, false offers, or copied content are prohibited.


5. PRICING & COMMISSIONS

  • Sellers are free to set product prices subject to platform policies.

  • My City Prime Store may charge:

    • Commission per sale

    • Listing or subscription fees

    • Promotional or advertising fees
      (as agreed separately or displayed on the seller dashboard)

  • All applicable taxes remain the seller’s responsibility unless stated otherwise.


6. ORDERS, SHIPPING & DELIVERY

  • Sellers are responsible for packaging, dispatch, and timely delivery.

  • Shipping timelines must be clearly communicated.

  • Delays, damages, or delivery failures caused by the seller may result in penalties or account suspension.

  • Logistics partners may be assigned by the Platform or chosen by the seller, subject to approval.


7. RETURNS, REFUNDS & CANCELLATIONS

  • Return and refund policies must comply with consumer protection laws.

  • Category-specific return rules may apply.

  • Sellers must process approved refunds within the defined timeframe.

  • My City Prime Store reserves the right to intervene in disputes.


8. PAYMENTS & SETTLEMENTS

  • Payments collected from buyers will be settled to sellers after deductions as per agreed terms.

  • Settlement cycles will be defined on the seller dashboard or agreement.

  • My City Prime Store is not liable for banking delays beyond its control.


9. BUYER RESPONSIBILITIES

Buyers agree to:

  • Provide accurate shipping and contact details.

  • Use the Platform for lawful purposes only.

  • Avoid misuse, abuse, or fraudulent activities.


10. INTELLECTUAL PROPERTY

  • All platform content including logo, design, layout, and software belongs to My City Prime Store.

  • Sellers retain rights to their product images and descriptions but grant the Platform a license to use them for marketing and display.

  • Unauthorized copying or misuse of content is prohibited.


11. PROMOTIONS & MARKETING

  • The Platform may run discounts, campaigns, or promotional offers.

  • Participation in promotions may be optional or mandatory depending on category and campaign rules.

  • Promotional terms may override standard pricing during campaign periods.


12. ACCOUNT SUSPENSION & TERMINATION

My City Prime Store may suspend or terminate accounts in case of:

  • Policy violations

  • Fraudulent activities

  • Customer complaints

  • Legal or regulatory issues

Pending settlements or disputes may be held until resolution.


13. LIMITATION OF LIABILITY

  • The Platform is not responsible for product quality, defects, or seller misconduct.

  • Liability is limited to the extent permitted under applicable laws.

  • Indirect, incidental, or consequential damages are excluded.


14. INDEMNIFICATION

Users agree to indemnify and hold harmless My City Prime Store against claims arising from:

  • Product issues

  • Legal violations

  • Intellectual property infringement

  • Breach of these Terms


15. DATA PRIVACY

User data will be handled in accordance with applicable data protection laws and the Platform’s Privacy Policy.


16. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of India.
Jurisdiction shall be subject to courts located in [DELHI].
